These terms & conditions relate to the purchase of a ticket or other product from Assertis Ltd through the website Railsmartr for Business. Assertis Ltd regulates the Service we provide, the relationship and what happens should something go wrong.

Your journey

The purchase of a ticket allows the user to travel on the National Rail Network and other systems or modes of transport and with the various Train Companies responsible for your journey. The National Rail Conditions of Travel ("NRCoT") govern that journey and apply to all domestic (non-international) journeys by passenger trains of the Train Companies on the National Rail Network. The NRCoT establish the minimum level of rights the site user is entitled to expect. They are available at the National Rail website and should be read by the site user as they affect your rights and responsibilities. Any variations or restrictions to the NRCoT will be set out by the Train Companies.

Who provides the Service?

Railsmartr for business Ltd is responsible for the supply of the ticket only. For any matter relating to the journey, such as cancellations, closures, missed connections, delays or problems with luggage, the relevant Train Company owns responsibility. Remember, the NRCoT will apply as a minimum standard and the passenger will be bound by the terms and conditions of the Train Companies who operate the train for their journey.

What do we provide?

Our Service is impartial. We provide a range of products and travel information without recommendation and for your personal use only. The site user chooses which ticket or product is the best for their needs. Certain ticket types are not sold by us and it may be possible to obtain different products and prices from the Train Companies' own ticket offices.

Do we charge for the Service?

In certain circumstances, we may make charges in addition to the ticket price. These will be clearly identified and agreed when a company account is activated. Any taxes or other fees incurred by a ticket purchase will be the responsibility of the Account holder. No fees for ticket refunds or journey changes are payable.

Your journey details

At the time the ticket is issued, Assertis Ltd will rely on any information provided through our website by the site user. This means that the destination, departure and arrival times, connections and any required personal or financial information must be correct and complete. Assertis Ltd is not liable for any compensation, expenses, claim or other loss arising from inaccurate or incomplete information provided by the user.

Please note that the information on the Railsmartr for Business website including train and journey times, routes, ticket types, prices and connections is provided by third parties. We cannot therefore guarantee that such information is correct.

The user is responsible for verifying such information with the Train Companies prior to departure and checking that they are able to complete your journey. This includes checking with the Train Company for disruption due to bad weather, strikes, engineering works or other reasons.

Transit times for travel in urban network may vary, for example London Underground or Metro services. These systems are operated by independent train operators. Please check for these details, especially transit for early or late trains, with those operators.

If a ticket is not genuine or is being used in breach of the terms and conditions of the Train Companies, the NRCoT or our terms and conditions, the ticket may not be accepted for travel at the gateline or on the train. If an invalid ticket is used on any part of the journey, the passenger may be unable to travel or be obliged to pay the fare plus a penalty. Please have any appropriate railcard used in connection with the ticket to qualify for any reduced prices, discounts or promotions.

Amendments, cancellations and refunds

Depending on the ticket purchased, it may be possible to amend the dates of travel or other aspects of the ticket. At the point of purchase, terms and conditions relating to the particular ticket will be detailed in the confirmation email and these will include information on whether you can amend, refund or cancel your ticket. These terms and conditions are decided by the train operating companies providing the fares. It is the responsibility of the site user to be sure that the ticket they purchase meets their needs.

Where a user decides to make an eligible amendment or refund, no administration fee will be charged. Please note that, where a refund is made, it will only be for the rail ticket part of the payment, and not for any booking fee or card payment fee. Only tickets purchased on the Railsmartr for Business site are eligible.

To apply for a refund, please email the Railsmartr for Business helpdesk at business@railsmartr.co.uk together with the booking reference number and images of any collected unused tickets cut diagonally across. Only emails received within 28 days of the expiry of the validity of the ticket will be accepted. Applications for refunds that are received by email later than this will not be approved. Confirmation that a claim is approved or if further information is required will be emailed by return within 24 hours Monday to Friday (excluding bank holidays).

How will tickets be received?
At the time of purchase, the user will choose how to receive their ticket. This is their choice and responsibility is accepted for the delivery details (email address) and its fulfilment unless varied below:

1. Collection from a self-service ticket machine or ticket office window at a station
Certain stations have self-service ticket machines from which ticket(s) are collected. If this method of delivery is selected, sufficient time must be allowed at the station to collect the ticket. To collect your ticket(s) you must have both your Collection Reference (an eight digit alphanumeric code that is displayed on your confirmation email) and a debit / credit card, this does not need to be the same one that you used to make the purchase with.

If the ticket machine is not working or is not accessible (for example, it is in a locked off part of the station), or there is any other reason why they cannot obtain the ticket from the machine, please contact the station staff in the first instance. If station staff are not available, or cannot help, then please contact us business@railsmartr.co.uk. We will do our best to assist but will not be able to issue replacement tickets. Responsibility lies with the passenger to ensure that they have a valid ticket for their entire journey.

Tickets will be ready for collection 15 minutes after the booking is confirmed. Please allow for this time.

2. Email PDF or PKPASS eTicket
For most journeys we offer the option to have tickets sent via email. Please note that when booking on behalf of someone else, the confirmation email and eTickets will be sent to the user who places the booking only.

If eTickets are selected, please ensure that the passenger is able to access the internet at the time of travel or to download the ticket in advance of making their journey. If the passenger has an Apple device they may use the wallet to store the PKPass. Network or mobile operator charges may apply.

Please follow any instructions given. Please ensure that the ticket is printed or displayed in the correct form. The user accepts responsibility for any such printing costs.

Group Bookings

For any booking that is for more than one person, all those travelling on that booking must travel together at all times.

Please take note of any additional restrictions or conditions relating to this method of delivery and the tickets available through it. These will be detailed in the confirmation email sent at the time of booking.

We make every effort to supply the Service using reasonable care and skill but are not liable for the provision of information used in the Service that is provided by third parties. Such information can be subject to change.

Assertis Ltd has no liability in respect of negligence or failure to follow these instructions (oral or in writing), misuse, alteration or abuse of the Service.

Any loss or damage suffered during a train journey is governed by the NRCoC and the relevant Train Companies' terms and conditions. Please contact a representative from the Train Company in the event of a problem.

Assertis Ltd shall not be liable by reason of any delay in performing, or any failure to perform, any of our obligations in relation to the Service, if the delay or failure was due to any cause beyond our reasonable control. If we fail to deliver ticket(s) in sufficient time before departure and such failure was within our control or we have been negligent, then you should contact us. Any reimbursement will be limited to the cost of the replacement ticket.

As far as the law allows, Assertis Ltd will not be liable for any damages resulting from loss of profits, business data, goodwill, contracts, revenues or other costs or losses arising out of or resulting from the user’s use of the Service. All warranties, statements and representations relating to the information, products and services provided as part of the Service are excluded as far as the law allows.

Assertis Ltd carries limited liability for death or injury resulting from our negligence.

Responsibilities

The site user confirms that the decision on which ticket or product to purchase is wholly theirs and that they are responsible for deciding the delivery method. They will also check that it is suitable for their needs and that they have the ability to receive the Service and pay for it. The user agrees to pay any additional charges levied by a network provider, mobile operator or similar service provider.

The site user agrees that they are using the Service for their own use or on behalf of a person for whom they are legally authorised to act. By using the Service, you warrant that the user is legally entitled to use the debit/credit card and provide the personal details and that the company holding the Railsmartr for Business account will be bound to pay the price for the Service.

Terms

Assertis Ltd shall provide the Service subject to these Terms and Conditions but we may subcontract any part of the Service. All the terms of the agreement contained in these Terms and Conditions unless varied and confirmed in writing. These Terms and Conditions may change from time to time but such changes will not affect a prior purchase.

Assertis Ltd may amend any error provided that the correction does not materially affect the Service. To contact a representative at Assertis Ltd, please do so at the address given below. The address given at the time the account is set up will be used by Assertis Ltd for any correspondence.

Certain parts of the Service or other products bought through the Railsmartr for Business website are provided by a third party. Assertis Ltd has no control over their terms and conditions and the user is bound by their terms and conditions when entering into an agreement with that third party.

If Assertis Ltd chooses not to take action against the site user, owning company or organisation for a breach of these Terms and Conditions, that will not be considered as a waiver of any subsequent breach of the same or any other provision.

If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions and the remainder of the provision in question shall not be affected.

These Terms and Conditions shall be governed by the laws of England and the account holder agrees to submit to the non-exclusive jurisdiction of the English courts.

If tickets are booked through Railsmartr for Business using a non-UK credit or debit card, then that purchase will be subject to the exchange rate and the purchaser will be responsible for any effect that may have on the ticket purchase.

Neither the site user nor Assertis Ltd intend any third party to be able to enforce any of these terms pursuant to the Contracts (Rights of Third Parties) Act 1999.
